To establish liability, a person must show that the business had actual or constructive knowledge of the substance. Constructive knowledge could be shown through evidence such as:

  • The hazard existed for a long enough period of time that the business should have known about it (for example, a puddle that was in the middle of the aisle for several hours); or
  • The hazard occurred with regularity, which made it foreseeable (a leaking air conditioner).
