The law that passed in 2003 under Governor Jeb Bush was very harsh on my clients. The law created a test called “Major Contributing Cause” which basically allows the carrier to deny cases where you have had a pre-existing condition. One of the most common neck and back injuries that have my cases being denied is degenerative disc disease disability.
The automobile cases and social security disability claims and workers’ compensation all deal with degenerative disc disease disability. The classic degenerative disc disease are as follows: i) some kind of stenosis which is painful and creates cramps, ii) some type of arthritis in the back like spinal arachnoiditis and iii) a nerve root compression or something that has a limited motion in your spine which has caused weakness and atrophy.
These are very complicated cases and you need to have an independent medical exam selected by me to help you defeat these defenses.
