The law that passed in 2003 under Governor Jeb Bush was very harsh on my clients. The law created a test called “Major Contributing Cause” which basically allows the carrier to deny cases where you have had a pre-existing condition. One of the most common neck and back injuries that have my cases being denied is degenerative disc disease disability.

The classic degenerative disc disease are as follows: i) some kind of stenosis which is painful and creates cramps, ii) some type of arthritis in the back like spinal arachnoiditis and iii) a nerve root compression or something that has a limited motion in your spine which has caused weakness and atrophy.
