I have represented a number of individuals that are pedestrians that are hit by an automobile. These cases involve very serious injuries because the pedestrian does not have the protection of any helmets, automobile or other protective devices such as an air bag. Because our state is so climate friendly, we see lots of people outdoors walking or riding their bicycles on a daily basis.
In my practice, I have noticed a number of scenarios that cause my clients to be injured as a pedestrian.
1. BACKING INJURIES: These occur when someone is usually walking through a parking lot and someone backs into them as a pedestrian. This happens in Walmart parking lots as well as Publix parking lots and the individual driving the car is typically charged with the accident. The authorities cannot write a ticket on private property and it is important for you to get the drivers license tag of the vehicle that hit you if they flee.
2. TURNING ACCIDENTS: These accidents occur when an individual is walking down the street or down the sidewalk and an individual is driving a car and turns across the sidewalk. These accidents occur when the driver is usually in a hurry and trying to get into a store or a residence. Pedestrians must be careful when they are walking down sidewalks that have a number of bushes and trees.
3. BICYCLE/BICYCLE PATH: These accidents occur where an individual is riding on a bicycle path and the car runs into them. These typically occur when the vehicle’s driver does not pay attention and swerves into the bicycles path. Many times my clients were walking in this path but they to have the ability to obtain compensation for the at fault driver.
