In my automobile accident practice, I am constantly asked how to deal with the property damage. The property damage claim deals with getting your vehicle fixed and/or repaired. This is one of two claims that you have in a personal injury/car accident case. The two claims are personal injury and property damage claim.
The first way to get the claim resolved is to go through the other insurance company’s policy. This means that the other side will send a claims adjuster to take photographs and look at your vehicle. If the car needs to be repaired, then they will provide you with a rental car until the car is repaired. The problem is if the car is totaled. If the car requires more than 80% of the value of the vehicle to get it fixed, then they will total the vehicle and give you the fair market value.
The second way is to go through your automobile insurance. You must carry comprehensive collision on your policy in order to do it through your policy. This means that you will have a deductible and you will go through your insurance company and at some later date the other side will provide you your deductible.
