I have been representing injured people who have been involved in a motor vehicle accidents for over 23 years. The law has continued to change but unfortunately has made a turn for the worst. Florida’s Governor Rick Scott passed House Bill 119 by a very slim margin in the Senate on March 10, 2012. The insurance industry has claimed victory but it has placed limits on what you can obtain.
The most important change in the law is that you must notify your PIP carrier/automobile insurance carrier within fourteen days of the accident. If you do not contact the insurance company, then it will be assumed that you were not injured in a motor vehicle accident. This creates a window of two weeks for you to get acceptable treatment which includes emergency room visits, medical doctors, osteopaths, physician’s assistants, dentists and orthopaedic surgeons.
There has been a number of limits on what treatments you can be provided. The most important one is that you are limited to $2,500.00 for your chiropractic visits. The past payment of acupuncture and massage therapy have been eliminated. These were all covered under the old law but will no longer be paid. It is my concern that if you get these types of modalities you will be paying it out of your pocket.
