This past Saturday the Osceola County Sheriff Department set up a DUI check point near U.S. 192 and Partin Settlement Road. As they were diverting traffic into a local shopping center, a vehicle driven by Donald Geraghty fled thru the check point striking an officer. The officer returned gunfire and ultimately they found the suspect at Canoe Creek Road in St. Cloud, Florida.
The ultimate charges against the individual were attempted murder on a law enforcement officer and aggravated battery. If someone you know has been injured by a DUI driver, the negligence part of the case becomes more lucrative. This means that the aggravated liability acts like a punitive damage award in that the juries typically punish the individual who caused the accident while driving drunk.
A motor vehicle accident involving a DUI does not extinguish the insurance companies’ obligation to pay you for your bodily injury, loss of enjoyment of life, lost wages and medical bills.
