A day does not go by when someone has indicated that their doctor is leaving Florida because of the Medical Malpractice claims. The proponents of tort reform especially the insurance companies and medical associations do not ever supply information about the amount of physicians that have left the state.
An example would be the Texas reforms created in 2003. This law put strict caps on non-economical damages and there was study that found that there was no evidence of a decline in the access of care prior to this law being passed. The study found in fact the direct opposite and that Texas had more than enough physicians.
After reform is passed, the amount of physicians has remained the same but the amount of malpractice claims have dropped 70%. The increase in malpractice payments for physicians is no way related to whether or not there are valid malpractice claims.
