A Florida car accident claim can typically last, I want to say, three months to a year and a half.
A three months classic example: I got rear-ended, I didn’t feel real good, I’ve gone to the family doctor, and I’ve done some physical therapy. I’ve gone to the neighborhood chiropractor, he’s done some treatment, three times a week for a month or two, then he goes twice a week.
Those claims should be resolved in three months.
You need to be careful.
There are people out there that are only out there to get money from your PIP and there are doctors out there that will send you through the grinder. And I don’t want to say they’re are not truthful.
They are pushing the envelope, and you know what it is.
You’re going for a treatment when you don’t feel bad. These claims need to be cleaned up immediately.
I like to get an MRI, I want to see something that’s the gold standard so I can say, “Look Mr. Insurance Adjuster, look at this here. This is not just the doctor saying he’s got a pulled muscle.”
The cases that take long are the ones with surgery. You’ve got a surgery, you’ve got to let it go six months to a year. I don’t want to settle your case, and then all of a sudden, “Oh Frank, I needed another surgery”, that’s a mistake a lot of people make.
They have the surgery, they get the money. Go ahead, have the surgery, reach the plateau of Maximum Medical Improvement.
If you file a lawsuit, I’m going to tell you two years post accident. You better be at trial within two years or somebody’s dragging their feet.
